Terms of Service

1. Acceptance of Terms
By using BioFrame ("Platform"), you fully accept these Terms of Service. If you do not accept these terms, do not use the Platform.
The Platform is intended exclusively for authorized healthcare professionals (posturologists, physiatrists, physiotherapists, osteopaths, etc.) operating in Italy or the European Union.
2. Definitions
- •"Platform": BioFrame, AI-powered web application for postural analysis
- •"User": Registered healthcare professional
- •"Patient": User's patient/subject undergoing postural evaluation
- •"Evaluation": Postural analysis generated via AI (Claude API)
- •"Health Data": Postural photos, medical history, clinical notes of Patients
3. Services Offered
The Platform provides:
- •Upload and management of Patient postural photos
- •AI-powered evaluation generation through advanced language models
- •Secure health data storage (GDPR compliant)
- •Evaluation report export (PDF, future)
MEDICAL DISCLAIMER
AI evaluations are decision-support tools, they do not replace medical diagnosis. The User is solely responsible for final clinical decisions.
4. User Obligations
The User agrees to:
- •Be an authorized healthcare professional with a valid license
- •Obtain written informed consent from Patients for:
- —Health data processing (Art. 9 GDPR)
- —Use of photos for AI analysis
- —Data storage on the Platform
- •Not upload data of minors without parental consent
- •Keep access credentials confidential
- •Not share accounts with unauthorized third parties
- •Use AI evaluations as support, not as the sole diagnostic basis
5. Data Ownership
Patient Data Ownership: The User is the independent data controller for Patient data. BioFrame acts as a data processor (Art. 28 GDPR).
AI Evaluations: Generated reports belong to the User. BioFrame does not claim intellectual property rights over AI-generated content based on User data.
AI Training: Patient data is NOT used to train AI models. Anthropic Claude API is configured to not retain input/output.
6. Limitation of Liability
Limitation of Liability: BioFrame provides the Platform "as is". We do not guarantee:
- •Absolute accuracy of AI evaluations (subject to technological limitations)
- •100% service uptime (possible maintenance)
- •Compatibility with all hardware/software configurations
The User is exclusively responsible for:
- •Clinical decisions based on Platform evaluations
- •Malpractice claims arising from improper use
- •Violations of Patient consents or GDPR
7. Service Termination
Account Deletion: The User may request account deletion at any time by contacting privacy@bioframe.it.
Data Export: Before deletion, the User can export all Patient data (portability Art. 20 GDPR).
Post-Deletion Retention: Health data retained for 10 years (legal obligations under Italian Legislative Decree 196/2003), then securely deleted.
8. GDPR Compliance
BioFrame is fully compliant with EU Regulation 2016/679 (GDPR) and Italian Privacy Code (Legislative Decree 196/2003).

9. Changes to Terms
BioFrame reserves the right to modify these Terms. Substantial changes will be communicated via email with 30 days' notice. Continued use of the Platform after changes implies acceptance.
10. Governing Law
These Terms are governed by Italian law. Competent jurisdiction: Court of Modena.
